Your California Privacy Rights
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits Users who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third-parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third-parties with which we shared information in the immediately preceding calendar year. California Consumer Privacy Act (“CCPA”)
If you are a California resident, the CCPA provides you certain rights and choices regarding how we collect, share, use, and protect your “personal information” and how you can exercise those rights. The CCPA defines “personal information” as information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly, or indirectly, with a particular consumer or household.
This CCPA Notice does not apply to the personal information we collect, use or disclose about consumers who initiate or complete the process of applying for financial products. Such information is subject to the Gramm-Leach-Bliley Act, or other federal privacy regulations, and is our Financial Privacy Policy which can be accessed here.
To the extent that we collect “personal information” that is subject to the CCPA, that information, our practices, and your rights are described below.
Information: You can request information about our collection and use of your “personal information” over the past 12 months. Once we receive, and verify, that it is coming from you, or someone authorized by you, we will disclose to you or your representative: (1) The categories of “personal information” we collected about you; (2) The categories of sources for the “personal information” we collected about you; (3) Our business or commercial purpose for collecting or selling that “personal information”; (4) The categories of third parties to whom we sold or disclosed the “personal information” for a business or commercial purpose; (5) The business or commercial purpose for which we sold or disclosed; and (6) The specific pieces of “personal information” we collected about you.
Under CCPA, you also have the right, subject to exceptions, to request:
- Access or know more about personal information collected by Splash.
- Deletion of personal information about you which we have collected or maintained, subject to certain exceptions.
- Correction of inaccurate personal information that we maintain about you.
- To opt-out of the sale of your personal information. We do not collect or sell the personal information of minors under 16 years of age.
- To limit the use or disclosure of sensitive personal information we maintain about you. We do not use or disclose any sensitive personal information other than as allowed by the CCPA and its implementing regulations.
Categories of Personal Information:
Splash has collected, maintained and used the following categories (with examples) of consumer Personal Information in the preceeding 12 months:
Splash may use (and may have used during the preceding 12-month period) your personal information for the purposes described in this Privacy Policy and for the following business purposes:
- Performing services, including maintaining or servicing accounts, providing customer service, processing credit applications on behalf of our lending partners, verifying customer information, processing payments;
- Helping to ensure account security and integrity;
- Undertaking activities to verify or maintain the quality or safety of our services or devices and to improve, upgrade or enhance them;
- Debugging to identify or repair errors;
- Undertaking internal research for technological development and enhancement; and
- Managing relationships with current or prospective lending partners, vendors, and service providers.
Retention
Splash retains your Personal Information for as long as we believe is necessary or appropriate to achieve the business and commercial purposes that we've notified you of, as set forth above or to comply with applicable law, audit requirements, regulatory requests, or orders from competent courts.
Sources of Personal Information:
- Directly from you
- Your device, such as when you use our Online Services
- Vendors who perform services on our behalf
- Our business partners
- Credit bureaus, credit reporting service providers, and other data brokers and resellers that provide Personal Information
Disclosure, Sale, or Sharing of Personal Information:
Splash has disclosed for a business purpose in the preceding 12 months the categories of Personal Information to third parties or service providers described above. The CCPA provides consumers with the right to opt out of the sale or sharing of Personal Information by a business. Under California law, "share" means disclosing your Personal Information by us to a third party for cross contextual behavioral advertising in exchange for money or anything else of value. Splash may engage in cross contextual behavioral advertising and will not sell your Personal Information.
Also, it is our business practice not to sell Personal Information of minors under 16 years of age and we have no actual knowledge of doing so. We also have not used or disclosed Sensitive Personal Information outside of the exceptions allowed for in the CCPA and its implementing regulations.
How to Submit A Request
To exercise rights described above, please submit a verifiable consumer request to us by either writing to the address above or emailing us at privacy@splashfinancial.com. You may only make a verifiable consumer request twice within a 12 (twelve) month period.
Making a verifiable consumer request does not require you to open an account with us. We must be able to verify your identity or authority to make the request and confirm the personal information relates to you. We will only use information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
You may authorize another individual or a business, called an authorized agent, to make requests on your behalf. We require that you and the individual complete notarized affidavits to verify the identity of the authorized agent and confirm that you have authorized that person to act on your behalf.
We will try and respond to a verifiable consumer request within 45 days of its receipt. If we require more time, we will inform you of the reason and extension period, not to exceed 90 days, in writing. Splash is required to support verifiable consumer requests for information maintained as of January 1, 2022. You may request access and provide a date range for the personal information Splash has collected within the period preceding the verifiable consumer request's receipt. We do not charge a fee to process or respond to your verifiable consumer request.
Splash processes Global Privacy Control preference signals and applies the Global Privacy Control signal at the browser level. In some cases, browser or device settings may limit or prevent the display of cookie preference tools. Where this occurs, Splash will continue to honor the opt-out preference signal as a valid request to opt out of the sale or sharing of personal information.
Right of Non-Discrimination: We will not discriminate against you for exercising any of your rights in this Online Privacy Policy and under applicable laws.
